5. Governing Law
These Terms & Conditions are governed by the laws of Waukesha, WI, USA. Any legal disputes will be handled under this jurisdiction.
6. Pricing & Estimate Validity
All price estimates provided by BMAdesigners are valid for 30 days from the date of issue. After this period, the estimate is no longer applicable, and a new estimate may be required. Prices are subject to change based on material costs, labor, and project scope. We reserve the right to update estimates to reflect current pricing at the time of re-evaluation.
7. Pricing Adjustments & Unforeseen Conditions
At BMAdesigners, we prioritize safety above all else, following our principle: Safety First, Priority Second, Then Project. All price estimates are based on the initial project assessment and are subject to change if unforeseen conditions arise.
If, during the project, issues such as mold, structural damage, hidden defects, or other safety hazards are discovered, additional work may be required to ensure a safe and compliant outcome. In such cases:
- A revised estimate will be discussed and agreed upon before proceeding.
- If the customer declines the additional work required for safety, we reserve the right to pause or modify the project scope accordingly.
- Any necessary changes to the estimate will be reflected in the final pricing.
8. Payment Terms
For all projects, BMAdesigners follows a structured payment plan to ensure smooth project execution. Payments are divided into three equal installments as follows:
- 1/3 of the total cost is due before project commencement.
- 1/3 of the total cost is due at the project’s midpoint.
- 1/3 of the total cost is due upon project completion.
All payments must be made according to the agreed schedule. Failure to complete payments may result in project delays or suspension until outstanding amounts are settled. Additional costs due to unforeseen conditions (as outlined in the Pricing Adjustments & Unforeseen Conditions section) will be discussed with the client before proceeding.
9. Project Start Date & Payment Processing
The official start date of a project is the date agreed upon in advance between BMAdesigners and the customer. If a payment is made before the agreed start date, it does not affect or change the official project start date.
For example, if the project is scheduled to start on March 1, but the customer makes a payment on February 20, the project will still commence on March 1, and the deadline will be calculated based on that date. Payments made prior to the start date will be processed accordingly, but they do not accelerate the project timeline.
Customers should not expect work to begin before the agreed-upon start date, even if payment is made earlier.
10. Project Deadline & Business Days
All project timelines provided by BMAdesigners are calculated in business days, which exclude Saturdays, Sundays, and public holidays unless otherwise agreed in writing.
For example, if a project is estimated to be completed in 20 days, this means 20 business days, not calendar days. Customers should consider this distinction when planning their schedules and expectations.
Unforeseen circumstances such as weather conditions, material delays, or required safety adjustments may also impact the timeline, and any changes will be communicated to the client as needed.
11. Insurance-Related Issues & Communication Requirement
If, during the course of the project, the client encounters an issue that requires communication with an insurance company, the client must first notify and consult with BMAdesigners before proceeding with any discussions with the insurance provider or other third parties.
This ensures that we, as the contractor and project executor, can provide accurate project details, necessary documentation, and professional input regarding the situation.
Failure to inform us beforehand may result in misunderstandings or delays in resolving the issue. Our team is committed to assisting clients with any necessary information or clarifications required for insurance-related matters.
12. Termination Rights
- We reserve the right to terminate accounts or restrict access if users abuse the site.
- Misuse includes hacking, spamming, and fraudulent activity.
13. Changes to Terms & Conditions
- We may modify these terms at any time.
- Changes will be effective immediately upon posting.
